Mobilization is ongoing in Ukraine, and caring for disabled parents is one of the reasons for deferment. At the same time, in practice, difficulties may arise if a person has other adult first-degree relatives, even if they live outside the country.
Mobilization continues in Ukraine, but some conscripts have the right to a deferment – one of the most common reasons is caring for parents who have group I or II disabilities. Lawyers explained the details on the “Yuristy.UA” portal.
What do you need to know about deferred care?
Lawyers note that the right to a deferral is possible provided that there are no other first-degree relatives who are obliged to support the person with a disability. If such relatives exist, but are abroad, this does not always guarantee a positive decision.
Experts explain that the presence of a brother or sister outside Ukraine does not in itself relieve them of the obligation to provide material assistance. Therefore, the CCC may refuse to postpone if the person with a disability still has able-bodied children.
At the same time, some lawyers believe that in some cases such a decision can be appealed in court. The final decision depends on the specific circumstances of the case and documentary evidence of the right to care.
