In Ukraine, DBN (state building codes) are in force. Their compliance is mandatory. In 2026, the norms regarding the minimum required distance between trees and the fence have not changed.
What should be the distance from the tree to the fence now?
DBN applies specifically to those trees that are located next to the neighbor's plot, reports the Government Portal.
The regulations set a minimum distance at which trees and shrubs can be planted on the adjacent side of the land plot so as not to obstruct neighbors. These regulations do not apply to other sides, for example, those bordering the street,

Interesting! For a bush, the minimum distance is 1 meter.
The specified DBN were established in 2019. That is, they have been in effect since that time.
To calculate how far away a tree should be, you need to take into account the following nuances:
- this distance must be at least half the diameter of the crown;
- The distance from the trunk to the fence should be at least 4-6 meters, as reported in DBN B.2.2-12:2019.

In order not to repeat the plot of “Kaydash's Family”, the new regulations establish a minimum distance at which trees and shrubs are allowed to be planted on the adjacent side of the land plot, so as not to obstruct neighbors.
That is, in practice, the situation looks like this: a tree with a 10-meter crown should be planted at a distance of at least 5 meters. This way, the branches will not enter the neighboring territory.
What else is important for land owners to consider now?

The State Building Code (DBN) regarding the height of the fence has also not changed in 2026. The maximum height from the street side can be 2.5 meters.

But between neighbors, the fence should be slightly smaller. In this case, the maximum is 2 meters.

It is impossible to legalize a fence that is higher than the standards. For violation, you will have to pay a fine, and in addition, you will have to replace the fence or change its design.
