It happens that a tree planted close to the fence with neighbors can become the cause of a big quarrel. To avoid undesirable situations, it is worth referring to legislative norms that clearly regulate the distance.

How far should you stand back from the fence?

New state building codes for urban development establish a minimum distance between the edge of a land plot adjacent to a neighboring plot and the nearest tree or bush, the Verkhovna Rada of Ukraine reports.

The norm applies only to new plots and summer cottages, so you won't have to cut down old trees and bushes on your plots. The regulation came into effect on October 1, 2019.

Important! According to the new DBN B.2.2-12:2019, the distance from the border of the adjacent land plot to the planted bushes should be 1 meter, and from 4 to 6 meters to the trunks of trees, depending on the crown, but not less than half its diameter.

So, if the crown of a tree has an average diameter of 9 meters, then the distance from the border of a neighboring plot should be at least 4.5 meters so that its branches do not enter the neighboring territory.

What norms are provided by the legislation of other countries?

In Ukraine, there are clear regulations that regulate the distance from the border of a neighboring plot to plant trees. In other countries, this distance varies significantly, sometimes even depending on the region. This is due to different climatic conditions, soil types, local laws and customs.

However, other European countries also have strict regulations. For example, Germany and France have detailed rules regarding tree height and distance from the border.

  • In France, the distance to the boundary depends on the expected size of the crown of the adult tree. For small trees, 1-2 meters may be sufficient, while for large trees it will be 5-10 meters.
  • In the US , regulations may vary from state to state, but are generally less strict than in Europe. However, there are restrictions on the height of trees, especially in urban areas. Typically, the minimum distance from the property line is 2 to 5 meters. However, for large trees, such as oaks or maples, this distance may be greater.
  • In Asia, the norms are also diverse. In Japan , for example, great attention is paid to aesthetics, so the distance between trees is determined not only by law, but also by tradition.
