For many Ukrainians, a private house is not only a place to live, but also a space that they want to expand over time or even equip for several generations of the family. This is often why the idea of building another structure on their own plot arises.
Is it possible to build a second house?
However, in practice, there are many legal nuances here – from the intended use of land to urban planning restrictions and real estate registration. Channel 24 looked into the details.
Previously, the Ministry of Community and Territorial Development responded to a request from the DreamDim company regarding the possibility of building two individual residential buildings on one private plot of land. The department referred to the norms of the Civil and Land Codes, as well as the Law of Ukraine “On Regulation of Urban Planning Activities”, where a residential building is written in the singular.
Taking into account the above, the legislation does not provide for the construction of two or more individual residential buildings (homesteads) on one homestead plot of land,
– they noted in the letter.
At the same time, there are no restrictions on the number of other outbuildings – garages, summer kitchens, sheds, workshops, or even guest houses. However, it will not be possible to register there or later sell such a “second home” separately.
Is there a solution to the problem?
It is possible to legally build two residential buildings only if the land plot is divided, which involves the services of surveyors and the subsequent registration of new cadastral numbers and addresses.
Experts from the Center for Free Legal Aid remind that in some cases this may not be possible. For example, when it is not possible to arrange separate access to the street or driveway for each newly created part.
According to lawyers, too small an area can also be a problem. It is not always possible to comply with the minimum size of the backyard territory, building codes regarding distances between structures or access for fire equipment, etc.
What else is worth knowing about home improvement?

As a reminder, building codes stipulate that the height of the fence between plots should not exceed 2 meters, and on the street side – 2.5 meters. At the same time, the legislation does not specify who should pay for the installation of a fence between neighbors, so owners usually agree on the division of costs themselves.

It is okay to cut down trees on your own property as long as it does not harm other people or the environment. However, in some cases, it is worth coordinating such actions with local authorities, particularly if it affects the state of flora, fauna, or neighboring areas.
