New building rules in Ukraine – what has changed for neighbors

Ukraine has simplified the rules for building private homes, but at the same time tightened the requirements for respecting neighbors' rights. The new regulations are already in effect and are changing the approach to development across the country.

Housing construction rules have been updated in Ukraine

Ukraine has updated the rules for the construction of private housing. The relevant changes are enshrined in Government Resolution No. 305 of March 4, 2026 and have already entered into force.

The main innovation concerns buildings with an area of up to 200 square meters and a height of up to two floors. For such objects, the need to obtain a building passport has been abolished – now it is enough to draw up a plan of development intentions.

This document is prepared by a certified architect or engineer. It specifies the parameters of the future building, its location, facades, and connections to utility networks.

Registration has become faster and less bureaucratic, as all data is immediately entered into the state electronic construction system. This allows for faster registration of documents and provides real-time control over objects.

Please note! At the same time, the new rules significantly tighten the requirements for respecting neighbors' rights. In particular, “Zemlyak” reports, it is prohibited to erect structures or install fences that block access to sunlight or disrupt the ventilation of neighboring plots.

What else do the new rules prohibit?

Changes in the terrain that could lead to flooding or create excessive noise and other inconveniences for the environment are also not allowed.

Experts emphasize: any changes to the site – from construction to the installation of small structures – can have legal consequences for the owner .

To avoid conflicts, experts advise discussing plans with neighbors in advance, agreeing on controversial points, and recording agreements in writing.

In general, the new rules change the balance between simplifying procedures and the responsibility of owners: building has become easier, but the requirements for compliance with the principles of good neighborliness have become significantly stronger.
