The Kyiv City Prosecutor's Office has sent charges to the court against the director of the Kyiv Municipal Academic Chamber Choir. He is accused of official negligence.
This was reported by the press service of the department.
The investigation established that the defendant signed an investment agreement. It was about the construction of an office building with a parking lot on the site of a municipal institution on Laboratornaya Street. According to the document, the investor was to pay the rent for the land. Later, an additional agreement was signed to the investment agreement, in which there was no longer a clause on the payment of rent by the investor.
“As a result, the municipal concert venue paid for land used by a private company for over 4 years. The official should have taken steps to change this clause of the agreement. And to settle the issue of paying for land in such a way that the municipal enterprise would not pay for a plot of land that it did not use,” the report says.
Since the defendant did not do this, the capital's budget suffered losses of almost 1.9 million hryvnias. This is the amount the municipal enterprise paid for land lease over several years.
Sanction Part 2 of Article 367 Official negligence, i.e. improper performance of one's official duties due to a dishonest attitude towards them, which has caused serious consequences for state interests protected by law. The Criminal Code of Ukraine provides for up to five years of imprisonment with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
The prosecutor's office noted that during the pre-trial investigation, the investor reimbursed part of the funds – UAH 1.71 million. Along with the indictment, law enforcement officers sent a civil lawsuit to the court for the remaining unreimbursed money.
The prosecutor's office traditionally does not name names, but according to Opendatabot.ua, “The Municipal Academic Chamber Choir “Kyiv” is led by Mykola Hobdych.”
