Details
Prosecutors from the Office of the Attorney General upheld the state’s case and advocated for this specific penalty.
The perpetrator is a rifleman within the 1st Marine Company of the 1st Battalion of the 40th Independent Marine Brigade belonging to the Russian Federation’s Pacific Fleet.
The court determined that in January 2025, amid combat in the Kursk region of Russia, he and other military personnel established an ambush. Two Ukrainian soldiers yielded – having discarded their weaponry and raised their hands. Irrespective of this, the defendant initiated direct fire upon them. Both prisoners of war perished.
The court reasoned that there existed no operational requirement for utilizing force, and the convicted individual was mindful of the order’s illegality and possessed the capacity to decline its execution.
The invader’s conduct was categorized under Part 1 of Article 28 along with Part 2 of Article 438 of the Criminal Code of Ukraine – a breach of the regulations and customs of war perpetrated by a collective, resulting in the demise of individuals safeguarded by international humanitarian law.
Furthermore, the court partially approved the civil claim and mandated the recovery of UAH 50 million as compensation for emotional distress from the convicted party for the benefit of the casualty.
We are methodically uncovering Russia's wartime transgressions and guaranteeing that those accountable are brought to justice. Responsibility for each war crime is unavoidable.
– emphasized Ukraine’s Prosecutor General.
