For many Ukrainians, their own business has long become not just a source of income, but a way to stay afloat during the war. Therefore, even after mobilization or military service, many people are in no hurry to close their individual businesses.
Can defense attorneys own their own businesses?
However, the law establishes a number of restrictions – certain categories of military personnel are prohibited from engaging in entrepreneurial activities. The details were explained by experts from the 7eminar portal.
First of all, it is worth noting that mobilization or contract service does not terminate the status of an individual entrepreneur . That is, the defender can remain a registered individual entrepreneur and not formally close his own business.
At the same time, in practice, many people have another question – how to support the work of a business if you are unable to do it yourself. In this case, some of the affairs can be transferred to another person through a power of attorney. For example, authorize them to sign contracts, make payments, or submit reports.
Please note! Information about mobilization or service under a contract is transmitted to the tax office automatically. However, to avoid possible misunderstandings, you can submit the appropriate application and copies of supporting documents yourself.
Who is prohibited from combining service with business?
However, not everyone is allowed to engage in entrepreneurship while serving. The restrictions apply to military officials who perform the following functions:
- organizational and administrative (i.e., management of the unit);
- administrative and economic (property and resource management).
So, it is not the military rank that is of key importance, but the position and list of responsibilities . If you have any doubts, experts from the Ministry of Justice advise you to clarify the details in the personnel service of the military unit.
What else should military personnel know?
Specialists of the National Bank's educational platform “Garazd” also reminded about credit benefits for Ukrainian defenders. And although the legislation does not cancel the debt itself, servicemen and their spouses may not pay interest, penalties, and fines for failure to fulfill obligations.
However, the benefit does not apply to some targeted loans – for the purchase of a home or car, as well as for the installation of solar panels, wind power plants, and energy storage systems, if their cost is compensated by the state or third parties.
