Extract from the State Registry Office – what kind of document is it and when is it mandatory?

An extract from the State Land Cadastre is a key document for any land transactions. Without it, it is impossible to sell a plot of land or officially confirm its parameters.

What is an extract from the State Registry Office and what information does it contain?

Lawyer Artem Ripenko said in a commentary for Channel 24 that an extract from the State Land Registry is essentially a kind of “passport” of the formed land plot. It contains basic information about the land.

The extract itself only reflects the information contained in the State Land Registry, in particular: area, configuration, boundaries, purpose of the plot and information about its normative monetary valuation. The latter are required for calculating land tax and rent for state and municipal land, tax and other payments (when alienating a land plot, contributing it to the authorized capital of a business company).

According to the lawyer, the extracts may also contain other important data – regarding restrictions on the use of the land plot established by regulatory legal acts, urban planning and land management documentation, measures to protect land and soil, etc.

When is an extract from the State Registry Office needed?

In accordance with Article 7 of the Law “On the State Land Cadastre”, extracts are provided by the bodies of the State Geocadastre, which maintain the land register (which is a document, i.e. a component of the State Land Cadastre).

Artem Ripenko notes that Article 24 of this law stipulates that in confirmation of the state registration of a land plot, the applicant is issued an extract from the State Land Cadastre about the land plot free of charge.

The extract contains all the information about the land plot entered in the Land Register. An integral part of the extract is the cadastral plan of the land plot,

Important! So, in fact, without such an extract, you cannot take any legally significant action regarding the land plot, as well as obtain official information about it, which is contained in the State Land Registry. In certain cases specified in the law, extracts are provided free of charge, in others – on a paid basis.

Who owns the land on which the house is built?

  • In Ukraine, when buying a house, ownership of the house and land is transferred to the new owner simultaneously.

  • Acquisition of ownership of land plots can occur through various civil law agreements, privatization, inheritance, or allocation of a share.

At the same time, if the previous owner owned a share of the land plot in joint ownership, the new owner of the real estate property shall be entitled to ownership of such share of the land plot.
