Sometimes trees can grow on land plots that the owner of the plot does not need at all. Old trees can fall and damage something, threatening the safety of people. Therefore, the question arises – is it possible to cut down trees on your land in such circumstances?
Is it possible to cut down trees on your own property?
The answer was provided by the Berdychiv City Council.
If the land is privately owned (or even if this land is not privatized), there is a house or outbuildings there – the decision to remove the tree is made by the owner himself.
At his own discretion, he decides what to grow on his plot of land,
– the council noted.
Please note! The owner does not need to apply to any authorities for permission.
However, other possible circumstances should be taken into account, such as when the tree grows near or outside a fence.
According to the resolution of the Cabinet of Ministers of Ukraine “On Approval of the Procedure for Removing Trees, Bushes, Lawns and Flower Gardens in Settlements”, you should proceed as follows:
- submit an appropriate application;
- then a commission should arrive and inspect the tree;
- The next step is to draw up a report and determine the amount of compensation for the tree.
However, there are still some nuances. Thus, the removal of damaged trees or bushes can be carried out if their condition is threatened:
- life and health of people;
- property of citizens or legal entities.
In such cases, permits are issued after the work is actually carried out and are proof of their legality,

Important! You should still contact the local government body – with a corresponding application, as well as photo or video materials.
What else should you know about current legislation?

No specific person should pay for the installation of the fence – this is not specified in the legislation. However, neighbors can solve this problem among themselves and share the costs.
